    How to hire a Process Server

    Hiring a professional process server may seem like an easy task at hand, however with all the horror stories consumers need to be educated on how to select the right process server for the job.  There are definitely a lot of companies that promote process service some are reliable and some are not.  You definitely don’t want to be stuck with a process server that cannot deliver on his or her promise because it may eventually determine the outcome of your legal case.

    What to look for in a Process Server

    It is very critical that the client provide the process server with as much information as possible pertaining to the person(s) being served.  This will not only help you with a better outcome, it will also aid the process server in the field to make the correct identification.  Communication is the key when it comes to working with a professional process server and keep in mind this communication will go both ways.  If you have photos of the subject, vehicle description(s) anything pertinent to assisting the process server provide it.  There is no such thing as too much information.  Also, don’t wait until it is too late.  The process server you hire may require more time to serve the legal documents than you may have originally thought.

    Small Claims Court…Did you know ?

    If you have a claim against someone in the amount of $5000.00 or less, chances are you will find yourself filing a claim at a small claims court in your jurisdiction.  The individual suing is the Plaintiff in the case and the opposing party is the Defendant.  Unlike civil court and trials, this process is inexpensive and simple.  A judge will hear both sides and make a decision on who wins the case and how the issues are settled.  Keep in mind that you may speak with a lawyer prior to your court hearing, however a lawyer may not represent you in court.  The exception is if you are appealing from a small claims matter. 

    Notice must be given

    Once you have filed your case with the small claims court, the court will issue you a court date.  You will have to notify the Defendant in your case of this date.  This process is required by law or else you will lose your case and it will not be heard.  You may hire a process server to handle it for you.  At Motorcycle Messenger- Registered Process Server, we serve small claims actions all the time.  It is better that you leave it upto the professionals, however you may also have someone other than the party involved serve the papers on your behalf.  The fact is we are registered with the County of Los Angeles, we are bonded and insured.  Sometimes the situation can get dangerous and that is why it is important to allow a professional process server handle it. 

    Can I settle my case ?    

    If both the Plaintiff and Defendant agree the case may be settled prior to trial.  However, both parties must notify the court as such. 

    What happens if I don’t appear ?

    If you do not appear for your court hearing, the judge in the case may issue the Plaintiff (party suing) what he or she is requesting plus court costs.  A judgment in the case will be issued to the Plaintiff.  In this circumstance the Plaintiff can legally garnish your wages, take your money, and property to satisfy the judgment.

    The Birth of The Process Server (Part I)

    It was back in 1999 and I was working for a Law Firm in Century City.  I got my start as a clerk and worked my way up to Investigator.  It wasn’t soon after that I was assigned the assignment of the lifetime by one of the partners at the firm.  They knew me well, hardworking, dedicated, and complete with integrity.

    The assignment was to serve a practicing doctor at her home or office in Newport Beach, California. (If only I knew what I was getting myself into).  After several days of preparation and discussion with some of the associates at the firm, I decided to head out to her home before attempting to serve her at the office, if all else failed.  This would be a decision that I would live to never forget.
