    Process Server Court Testimony

    The Birth of The Process Server (Part II)

    I arrived at the subjects home at about 5:30 in the morning, it was dark out and I didn’t want to wake up any of the neighbors.  I turned the off the car and proceeded to collect myself for a few minutes and then decided to take action.  For some reason I thought in the back of my mind this early wake up call might do the trick in getting her served, and boy was I ever wrong. 

    I proceeded to ring her door bell in hopes she would come to the door.  Well, she did come to the door and I thought this was going to be done in no time.  I could see her through the side window, she was wearing a white robe and had blonde hair, I knew my subject was a white female with blonde hair.  I thought to myself, perfect I just need to convince her to open the door and then I could serve her with the summons and complaint. 

    This story was about to take a turn for the worst in no time and I had no way to protect myself.

    Can a Lawyer represent me ?

    Both parties in a case may consult with a lawyer, however, a lawyer may not represent you in a small claims action.  The exception is that after a judgment is handed down by the judge and if an appeal is filed, then both parties may be represented by a lawyer. 

    How does the defendant find out  I filed a lawsuit ?

    The defendant must be notified about your lawsuit filed with the small claims court.  The process is known as service of process, which includes giving the defendant a copy of the claim.

    The Birth of The Process Server (Part I)

    It was back in 1999 and I was working for a Law Firm in Century City.  I got my start as a clerk and worked my way up to Investigator.  It wasn’t soon after that I was assigned the assignment of the lifetime by one of the partners at the firm.  They knew me well, hardworking, dedicated, and complete with integrity.

    The assignment was to serve a practicing doctor at her home or office in Newport Beach, California. (If only I knew what I was getting myself into).  After several days of preparation and discussion with some of the associates at the firm, I decided to head out to her home before attempting to serve her at the office, if all else failed.  This would be a decision that I would live to never forget.
